Terms & Conditions

This is an English translation for convenience. The German version is legally authoritative.

1. Scope

These Terms & Conditions apply to the use of the Apply & Stay Jobs platform, operated by Michael Wierer, Nikitara 1, 19005 Mati, Greece (the "Provider"), by companies that publish job listings on Apply & Stay Jobs (the "Customer"). Deviating terms proposed by the Customer are not accepted unless the Provider expressly agrees to them in writing.

2. Service description

Apply & Stay Jobs is an online platform through which companies can publish multilingual job listings to reach candidates with foreign-language skills across Europe. The Customer selects one of the packages described on the platform (including "Basic", "Pro" and "Premium"), each with different features and terms.

3. Registration and user account

Using the platform requires creating a company account. The Customer is required to provide truthful and complete information when registering and to keep it up to date. Login credentials must be kept confidential; the Customer is liable for activity under their own account.

4. Packages, prices and payment terms

Current packages and prices can be viewed on the platform under "For Employers". Unless stated otherwise, all prices are exclusive of statutory VAT. Paid packages are billed monthly in advance and, unless otherwise agreed, can be cancelled at any time effective at the end of the current billing period.

The specific payment processing (payment provider, invoicing) will be communicated to the Customer during the ordering process or after the contract is concluded.

5. Term and termination

Contracts for paid packages run, unless otherwise agreed, on a monthly basis and are automatically renewed for a further month unless cancelled by the end of the current term. The right to extraordinary termination for good cause remains unaffected.

6. Customer obligations

The Customer warrants that published job listings are factually accurate, do not infringe third-party rights, and do not contain discriminatory, immoral or otherwise unlawful content, in particular with regard to applicable anti-discrimination law (e.g. the German AGG or equivalent provisions at the Customer's place of business). The Provider reserves the right to remove listings that violate these principles without prior notice.

7. Availability and liability

The Provider strives for the platform to be available as uninterrupted as possible, but does not guarantee this. The Provider is liable without limitation for intent and gross negligence, and in accordance with applicable statutory provisions for damages arising from injury to life, body or health. Otherwise, liability for damages caused by slight negligence is excluded, unless material contractual obligations are affected.

8. Changes to these Terms

The Provider reserves the right to amend these Terms with effect for the future, for example to adapt them to changed legal requirements or to the platform's feature set. The Customer will be informed of material changes in a suitable manner (e.g. by email).

9. Responsibility for applicant data

Applications received through the platform are made available to the Customer via a notification email (potentially including the CV as an attachment or link) and through the Customer's account. Upon receipt of these application documents, the Customer becomes the sole data controller, within the meaning of Art. 4(7) GDPR, with respect to the applicant's personal data contained therein. There is no joint controllership (Art. 26 GDPR) between the Provider and the Customer.

The Customer agrees to use the application documents received solely for conducting the respective recruitment process and to process them in accordance with applicable data protection law, in particular regarding permissible retention periods and timely deletion after the recruitment process concludes. The Provider assumes no liability for the nature, extent or duration of data processing carried out by the Customer after receipt of the application documents.

10. Final provisions

Greek law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer-protection provisions at the Customer's habitual residence require otherwise. Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
